Boundary Fence Law

There are many issues that people may wish to know more about the law when it comes to a boundary fence and how it affects them and their neighbours.

Perhaps you or your neighbour are erecting a new fence and the rough side of the fence is on your/their side and you want to know if they can be made to turn the fence around.

Painting the fence in your garden. There's a chance the fence belongs to your neighbour so you need to know what the consequences could be.

A neighbour erects a new fence and you feel it is intruding your privacy and you want to know what you can do about it.

Your neighbour erects a new fence which is too high, again, what can be done about this.

Your neighbour has a fence that is in a state of disrepair, it is an eyesore, it is unsafe for your children or pets to be in the garden unattended due to the state of the fence.

These are just a few of the issues that are faced with on a daily basis all around the country and most people do not know their right or anything about boundary fence law. This where myself as a chartered surveyor with knowledge of the law can help you.  - Some landowners may prefer to speak to a professional. The Royal Institution of Chartered Surveyors (RICS) operates a Boundary Disputes Hotline (0870 333 1600 that will put you in touch with a chartered surveyor who specialises in boundary demarcation and disputes and who will be prepared to spend  half an hour discussing and advising on your problem free of charge.
